Hello there, I did my first ESA claim in late 2013, had the WCA in summer 2014 and by that September I was put straight into the Support Group. Fast forward to March this year and a new ESA 50 arrives in post to complete, this was filled in by Age UK. I had the WCA on 1st August & it was worse than the first one, expected to get the decision by post, but on 1st September I got a call from DWP to say I had scored 0 points from Maximus (what a shock!) He went on to mumble about inconsistencies in report & more, it was intimidating and aggressive, I got very agitated & distressed and didn't know what to do. He implied if I answered the questions, I might not lose it all. The upshot was that he put me in WRAG and put the phone down. My son put me in touch with an ME/CFS support group, that has an older person who has a lot of experience of doing DWP applications, MR's, appeals etc., he did my MR, but didn't hold out much hope. This has been turned down (DWP policing themselves) so I need to decide if I appeal or as the advisor at support group is suggesting, wait a couple of months and start a new claim, partly under guise of my conditions being worse, submitting new evidence etc. I have never come across this, except for people who were found fit for work & ESA stopped?
The concerns I have are the £30 cut for people in WRAG for new claims from April 2017, having to have another face to face WCA and wouldn't they stop claim I have now? Couldn't I submit new evidence to the appeal? The M.R refusal letter is dated 25 TH October, though I didn't get it until the 28 th October, so appeal form has to be back by latest 25 th November. I will be seeing the advisor person at the support group next Tuesday and I need to let him know my decision, I have the relevant appeal form. What do others think please, I would welcome feedback/advice on this, my gut feeling is still to appeal?
hmm whot a advisor hay but one should be appealing it the you sais so I need to decide if I appeal or as the advisor at support group is suggesting, wait a couple of months and start a new claim, partly under guise of my conditions being worse, submitting new evidence etc. I have never come across this, except for people who were found fit for work & ESA stopped? im not sure but going down this road will not do has dwp said conditions being worse they not allowing this now but not quite sure you realy need to be heading ton tribunal again has they the dwp play games and hope some will not chase it to tribunal stage if you had your reconsideration of the dwp decision maker then its you who needs to tell your tribunal service that you taking it this far has dwp leaves it to us now come accross to dsiel.org were info is there to help you along this road it free and could open your eyes a bit more jeff3
right you now need to sar the dwp in all they used then i would be complaining to maximus about their highly trained hcp that her assessment was a pack of lies then the nurses union complain to about this nurse just keep posting if one needs more help jeff3
